SENIOR

Conditions:

He/she can cancel the booking 48 hours or less before the meeting. If he/she cancels after the full price will be charged.

Before cancelling, the following pop message should appear:

Pop-up message:

“Before cancelling, please be aware that you confirmed your booking with a companion who arranged his/her agenda to meet you and was looking forward to meeting you. Cancellation 48 hours or less before the meeting is not allowed and will be charged at full price”. By click on accept, you confirm accepting the above-mentioned conditions.”

COMPANION

Conditions:

Once he/she receives the booking request, he/she can cancel or accept the booking. Once the booking is confirmed, he/she will not be able to cancel the booking.

And if he/she does not show up at the meeting, the senior citizen can report it to info@alto.cool then the Admin can desactivate or suspend the account of Companion.

Before cancelling the following pop message should appear:

Pop-up message:

“Cancellation 48 hours or less before the meeting is not allowed. Before cancelling, please be aware that AltO.cool GmbH aims is to fight loneliness in Seniors' population. You confirmed to meet a Senior who is looking forward to meeting you and is in a lonely situation. Cancelling your meeting will have a negative psychological impact on him/her and hence on AltO.cool GmbH’s image and ultimately on your profile. If you have to cancel a meeting for an urgent matter, please be aware that it will be allowed once with a justification to AltO.cool GmbH administrator by informing AltO.cool GmbH by email to info@alto.cool. At the 2nd cancellation, AltO.cool GmbH will have the right to cancel your profile from our app. To not show at a booked meeting is also not allowed and will be monitored. In both situations, AltO.cool GmbH will have the right to cancel your profile because we take loneliness in Seniors' population very seriously. By click on accept, you confirm accepting the above-mentioned conditions.”

BEFORE USING OUR SERVICES PLEASE READ THESE TERMS OF USE CAREFULLY

1. TERMS OF SERVICES USE (“TERMS OF USE”)

These terms of use informs you of the terms of use on which you may make use of our app AtlO.cool GmbH or webservices www.alto.cool (“our services”), whether as a guest or as a registered user. Use of our services includes accessing, browsing, or registering to use our app or webservices. Please read these terms of use carefully before you start to use our services, as these will apply to your use of our app and webservices. By using our services, you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms of use, you must not use our services.

Our services are operated by AltO.cool GmbH (“AltO.cool” or “we” or “us”). We are registered in Zurich, Switzerland.

We may update our services from time to time, and may change the content at any time. However, please note that any of the content on our services may be out of date at any given time, and we are under no obligation to update it. We do not guarantee that our services, or any content on it, will be free from errors or omissions.

5. ACCESSING OUR SERVICES

We do not guarantee that our services, or any content on it, will always be available or be uninterrupted. Access to our services is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our services without notice. We will not be liable to you if for any reason our services is unavailable at any time or for any period. You are responsible for making all arrangements necessary for you to have access to our services. You are also responsible for ensuring that all persons who access our services through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

6. YOUR ACCOUNT AND PASSWORD

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use. If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us through an email to info@alto.cool.

7. PROPERTY RIGHTS

We are the owner or the licensee of all intellectual property rights in our services, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You may print off one copy, and may download extracts, of any page(s) from our services for your personal use and you may draw the attention of others within your organisation to content posted on our services. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Our status (and that of any identified contributors) as the authors of content on our services must always be acknowledged. You must not use any part of the content on our services for commercial purposes without obtaining a licence to do so from us or our licensors. If you print off, copy or download any part of our sit e in breach of these terms of use, your right to use our services will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

– use of or reliance on any content displayed on our services.

If you are a business user, please note that in particular, we will not be liable for:

– loss of profits, sales, business, or revenue;

– business interruption;

– loss of anticipated savings;

– loss of business opportunity, goodwill or reputation; or

– any indirect or consequential loss or damage.

If you are a consumer user, please note that we only provide our services for domestic and private use. You agree not to use our services for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We will not be liable for any loss or damage caused by a virus, distributed denial – of – service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our services or to your downloading of any content on it, or on any webservices linked to it. We assume no responsibility for the content of webservicess linked on our services. Such links should not be interpreted as endorsement by us of those linked webservicess. We will not be liable for any loss or damage that may arise from your use of them.

9. VIRUSES

We do not guarantee that our services will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform in order to access our services. You should use your own virus protection software. You must not misuse our services by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our services, the server on which our services is s tored or any server, computer or database connected to our services. You must not attack our services via a denial – of – service attack or a distributed denial – of service attack. By breaching this provision, you would be committing a criminal offence. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them.

10.APPLICABLE LAW

These terms of use, its subject matter and its formation, are governed by Swiss law. You and we both agree to that the courts of Switzerland will have exclusive jurisdiction over any claim arising from, or related to, a visit to our services.

Our services contains names and logos which are trademarks of AltO.cool GmbH. Unauthorised use of any of these trademarks is forbidden. Users of our services may print, copy, download or temporarily store information from our services for their personal use but all intellectual and other property information shall remain the property of AltO.cool GmbH and no rights in it shall be transferred to users. You may not reproduce (in whole or in part), transmit (by electronic means or otherwise), modify, link into or use for any public or commercial purpose this services, or any of its content, without the prior written permission of AltO.cool GmbH

We do not act as an employer and do not engage in the hiring of individuals for employment purposes. AltO.cool app just connects seniors with companions. AltO.cool GmbH does not assume any responsibility or liability for the actions, conduct, or outcomes resulting from connections made through our app. Companions are not AltO.cool GmbH employees. It is the responsibility of the companions to declare their earnings to the sociall security and tax offices.
